FREE ez-link CARD REPLACEMENT EXERCISE           EXTENDED TO 7 OCTOBER 2009

To facilitate current ez-link card holders who have yet to exchange their cards by 30 September 2009, the Land Transport Authority (LTA) is pleased to announce that there will be a further extension of the deadline by one week to 7 October 2009.

LTA has been monitoring the ez-link card replacement exercise, and has observed that in some stations, a number of commuters are still using the old ez-link cards. Thus, all card holders can continue to get a 1-for-1 replacement at any TransitLink Ticket Office and Singapore Post Office from now till 7 October 2009 (please refer to www.transitlink.com.sg for list of Ticket Offices and www.singpost.com for list of SingPost branches)

LTA would like to urge current ez-link card holders to replace their cards before the deadline to avoid any inconvenience. No further extension will be provided after 7 October 2009.

Commuters will not be able to use their old ez-link cards after 30 September 2009. However, card holders can still get a refund on any remaining value in their old card up to 12 years from the date the card is first issued from any Ticket Office.

Card holders, who have not exchanged their current ez-link card by 7 October 2009, will need to purchase a new CEPAS-compliant card for travel on public transport. The CEPAS-compliant ez-link card costs $15 (i.e. card cost of $5 and a $10 stored value) and can be purchased at all Passenger Service Centres and Ticket Offices.

The free one-for-one card replacement programme began at the start of 2009 on 9 January. With 92% of public transport trips already being made with CEPAS-compliant cards, the majority of public transport commuters are already using the new CEPAS-compliant cards. 4.5 million ez-link cards have already been exchanged for new CEPAS-compliant cards. Of the remaining old ez-link cards, about 200,000 cards are actively used on public transport.

WHAT CARD HOLDERS NEED TO DO

Card holders are encouraged to replace their card early before 30 September 2009.

To reduce waiting time for others,

a) Each person may exchange up to 3 ez-link cards at a time
b) Top-up service will not be provided at the card exchange counter. Commuters who need to top-up their cards may do so at the automatic top-up machines (GTMs and AVMs) and Passenger Service Centres.

Card holders whose current card has a value of less than -$3.00 should top up their card before exchanging it. Student concession cardholders should top-up their card if their current card has a value of less than -$1.00 before exchanging it.
   
At the point of card exchange, the current card will be retained. Any remaining value in the card will be transferred to the new card.
   
Non-transit applications for the new ez-link cards will be available progressively. Commuters who wish to continue to be able to use non-transit applications should exchange their cards at a later date, when these applications become available.
   
 


IMPORTANT POINTS TO NOTE IF THE CURRENT CARD HAS AUTO TOP-UP FACILITY (GIRO/CREDIT CARD)

You will need to replace your current card at any TransitLink Ticket Office.

 

At the Ticket Office, the current card will be retained and the auto top-up facility on the card discontinued when the card is exchanged. Refund on the current card will be transferred to the new card issued or to the designated credit card account.

 

Commuters who wish to continue using their card’s current auto top-up facility are advised to exchange their current card when these facilities for the new card are available.

 

Cardholders will need to re-apply for the facility for their new card. All cardholders who are on Auto Credit Card Top-up facility and bank GIRO will be advised directly via mail by the respective scheme owners about their card replacement procedures.

 



AUTO TOP-UP FACILITIES FOR NEW CEPAS-COMPLIANT EZ-LINK/CONCESSION CARD

Auto Top-Up facilities for new Adult ez-link card:
EZ-Link will offer two auto top-up facilities for the new adult ez-link cards:
(i) Auto Credit Card Top-Up facility, available from 16 April 2009 or
(ii) Auto GIRO Top-Up facility, available from 27 August 2009
More details on each of these facilities will be made available on the EZ-Link website at www.ezlink.com.sg at a later date.

 

Auto Top-Up facilities for new Concession cards:
Concession cardholders can re-apply for the facility when they receive their new card. Details of the application are as follows:

SeP/CEPAS (GENERAL)

Q. What is SeP or CEPAS?
SeP is a new ticketing system for public transit. It is based on the CEPAS standards. The SeP system is similar to the current e-payment system (EIFS), but is based on an open platform that allows multiple card issuers to provide cards. With SeP, commuters may choose between a CEPAS-compliant ez-link card issued by EZ-Link or a CEPAS-compliant card issued by other card managers in the future. This gives the public more choice.
   
Q. When was SeP launched?
SeP was launched in late-December 2008 and will run concurrently with the EIFS system until 30 September 2009.
   
Q. Why must I change my ez-link card?
The change is necessary as LTA is rolling out a new fare system (SeP). SeP is built on the CEPAS standard. Thus new CEPAS-compliant transit cards will be required.

 

FEATURES OF CEPAS-COMPLIANT CARD

Q. What are the benefits/features of the new CEPAS-compliant card?
The new CEPAS-compliant card offers commuters:

(i) Full access of the card’s stored value for transit and non-transit payments

Currently, the ez-link card has a $3 travel deposit which is not shown as the card balance. Hence, when the card reader reflects a card as having $0.01 there is actually a $3.01 value still in the card. The $3 value is locked in as a travel deposit and can only be used for travel on trains and buses. This is why commuters are able to start a train or bus trip with only $0.01 reflected in their ez-link card.

With the new CEPAS-compliant card, there is no travel deposit. The full value that the commuter deposits into his card can be used for transit and non-transit payments.

(ii) Multiple uses for the card

In addition to payment for public transport fares, the CEPAS-compliant card can eventually be used for other payments such as ERP transactions with the new generation in-vehicle unit (IU), Electronic Parking System (EPS) carparks, payments at shops and more.

   
Q. What is the difference between the current EZ-Link transit card and the CEPAS-compliant card?
Besides being CEPAS-compliant, the other difference is the no-deposit feature. In terms of usage for public transport, commuters will continue to tap in and tap out at the fare gate.
   
Q. What is a ‘Travel Deposit’?
Currently, the ez-link card has a $3 travel deposit which is not shown as the card balance. Hence, when the card reader reflects a card as having $0.01 there is actually a $3.01 value still in the card. The $3 value is locked in as a travel deposit and can only be used for travel on trains and buses. This is why commuters are able to start a train or bus trip with only $0.01 reflected in their ez-link card.
   
Q. Why was the ‘Travel Deposit’ removed?
The advantage of having no travel deposit is card holders can use the full value of their card for transit and non-transit purposes.
   
Q. Currently, I can still travel when I have a low value in my card. Can I still do so, with the new CEPAS-compliant card?
Currently, commuters can start a train/bus trip although the balance in the card is reflected as $0.01. This is because the actual balance in the card, including the $3 travel deposit is $3.01.

As the CEPAS-compliant card does not have a travel deposit; the card reader displays the real value remaining in the card. The commuter therefore cannot start a trip with $0.01 as that amount would not be sufficient to cover his fare.

As a general guide, commuters (adult anonymous card) are advised to have a minimal value of $3 in their card if they use the card for MRT travel. This value ensures that commuters have the required fare when they exit the gate, even for the longest train journey. A commuter cannot enter the MRT system with a negative card balance.

For bus travel, commuters must have sufficient value to cover the fare from the point of boarding to the end of the bus route/ interchange. At the point of exit, the unused fare is returned into the commuter's card when he taps out. This requirement applies to both the existing and new ez-link card. As minimum value for bus travel varies, we recommend a $3 balance if commuters are unsure of the fare. This $3 value is used because it is the balance required for entry to the MRT system, and would be easier for commuters to remember.
   
Q. Why must the fare cover the distance from the point of boarding to the end of the route for the service? Is this a new feature of the SeP system?
No, the way fare is deducted from the card is the same as the existing system. When the commuter first boards the bus, the fare required from the point of boarding to the end of route/interchange is initially deducted from the card. At the destination, the actual distance traveled is calculated when the commuter taps his card at the exit reader. The unused fare (from destination to end of route/interchange) is refunded into the card at the point of exit. This explains why, although a commuter’s actual fare may be $1.00, he may need, say $1.60 to board the bus (because the fare to the end of route for that service is $1.60).
   
Q.

What if I forget to top up?
To help remind commuters to top-up, an alert message will be displayed when the stored card value is:

  • Less than $5 (i.e. $4.99) for Adult Anonymous cardholders
  • Less than $5 (i.e. $4.99) for Senior Citizen concession cardholders who travel during concessionary hours,
  • Less than $5 (i.e. $4.99) for Tertiary Student, National Servicemen concession cardholders. (Note: Tertiary and NSmen pay adult fare if they do not purchase the concessionary stamp),
  • Less than $3 (i.e. $2.99) for Child/student concession cardholders.

With this alert feature, commuters would on average, be alerted at least 3 times to top-up their cards before their card value reaches the minimal required value for travel.

However, in the event that they still forget to top up and do not have enough fare to start their trip, they have the following options:

(i)

MRT: Top up their card at the ATM machine or Passenger Service Counter
(ii) Bus: Pay cash
Commuters will not enjoy a transfer rebate when transferring services in such a situation. This is similar to the current system.
   
Q. How does the alert message work?
When using the new ez-link CEPAS-compliant card, commuters should look at the card reader upon entry or exit from the bus/train. Commuters will get an alert message, reminding them to top-up their card when the stored value in their card is less than $5.

For Senior Citizen, Tertiary Student and National Servicemen concession cardholders this alert feature is set at less than $5 (i.e. $4.99). Child and student concession cardholders will be alerted when their card has less than $3 (i.e. $2.99).

Q. How can I know that my actual fare was deducted and the unused fare is refunded to my card?
Similar to the current system, the actual fare for the trip (i.e. amount deducted) and the remaining card value is displayed when you tap your card on the exit card reader.
   
Q. How can I check for the fare on the service that I’m taking?
You may check for the fare by referring to the corresponding fare band to the last stop indicated on the service information available at most bus stops. Alternatively, you may also obtain the information by referring to the TransitLink Guide or Public Transport Operators' websites.
   
Q. What is the minimal value that I require in my ez-link card for the various bus/train services?

As there is no travel deposit in the new ez-link card, the card reader displays the real value remaining in the card. Similar to the current card, new ez-link card holders need to ensure there is sufficient value in the card for their journey. Because the minimum amount* differs depending on the service used, LTA recommends using $1 (for child, primary, secondary, JC or ITE concession) or $3 (for adult cards as well as senior citizen, tertiary or NSmen concession) as a guide, so that card holders will always have enough balance on the card to cover the fare on basic bus services or the MRT/LRT.

For bus travel, commuters must have sufficient value to cover the fare from the point of boarding to the end of the bus route/ interchange. At the point of exit, the unused fare is returned into the commuter's card when he taps out. This requirement applies to both the existing and new ez-link card.

To illustrate, the minimal value required for a basic bus service (air-con service) is $1.65 if a commuter begins his journey from the start of the bus route/interchange to the end of the bus route/interchange. This minimal value will be less if he boards the bus at a later fare stage.

* This minimum sum does not apply to concession card holders who have a valid monthly concession pass which allows them unlimited bus rides/fixed number of MRT rides per day.

USING THE CEPAS-COMPLIANT CARD

Q. If I have a stored value of $3 when entering a MRT station and overstay, can I still exit the station?
Similar to the current system, commuters who overstay will have to top-up their new ez-link CEPAS-compliant card if they have insufficient funds in their card. There is an administrative fee $2 if commuters exceed the time allowed for their trip.
   
Q. What should I do if my new CEPAS-compliant card is not functioning properly?
If you face problems with the new card, please go to any TransitLink Ticket Offices for help.
   
Q. Besides the public transport system, where else can commuters use the new card?
Non-transit applications for CEPAS-compliant cards will be introduced progressively. For updates on merchants that accept the CEPAS-compliant cards for payments, card holders are encouraged to visit QB’s website at www.qb-link.com.

Motorists with vehicles fitted with the dual-mode IU can use the new CEPAS-compliant ez-link card for ERP payments immediately. However, motorists cannot use the new ez-link card with the dual-mode IU for parking payments until EPS car parks are progressively upgraded from October 2009.

 

CEPAS-COMPLIANT CARD & NEW GENERATION IU

Q. When will the new generation IU be introduced for private/commercial vehicles?
The dual mode IU is available for new taxis and other vehicles from 25 March 2009 and for new cars from 30 June 2009.
   
Q. Can I use the CEPAS-compliant card to pay for ERP transactions?
Motorists whose vehicles are fitted with the new generation In-vehicle Unit can use CEPAS-compliant cards to pay for ERP transactions immediately.
   
Q. When can I use the new card to pay for EPS charges?
The new CEPAS card can be used for EPS transactions at carparks that support the CEPAS standard. These carparks will be progressively ready to support the CEPAS-compliant cards from October 2009. Details will be announced end September 2009.

For now, only the NETS CashCard can be used with the dual-mode IU for parking payments at EPS car parks. Hence, motorists with vehicles fitted with the dual-mode IU are advised to also carry the NETS CashCard for parking payments if they are using the new CEPAS-compliant ez-link card with their IUs.

Q. Do I have to change my current IU to the new dual-mode IU?
Vehicle owners are not required to change their current IU to the new IU. Nevertheless, motorists who wish to change to the new IU may do so at LTA Authorised Inspection Centres at a cost of $150 (before GST and inclusive of installation). Motorists are advised to call the Centres beforehand to make an appointment.
 

Conditions for Issue & Use of Concession Cards ("Conditions")

The use of a Concession Card as a contactless stored value facility and as a Ticket and for payment of fares for travel in the Public Transport System and/or Qualified Goods and/or Services shall be subject to these Conditions, and all applicable laws and regulations. By using a Concession Card as a Ticket and for payment of fares for travel in the Public Transport System, the Concession Card Holder agrees to be and shall be bound by these Conditions.

1. Definitions

In these Conditions, the following words and expressions shall, unless otherwise provided or the context otherwise requires, have the following meaning:-

Act

means the Public Transport Council Act (Cap.259B) as amended from time to time.


Authorised Person

means such person authorised in writing by LTA to carry out such function as referred to in these Conditions.


AVM

means an Add Value Machine.


Card

 

Means any stored value facility whether in the form of a card or otherwise


Card Cost

means the cost of the Concession Card payable by a Concession Card Holder for the issuance of a Concession Card in such amount as may from time to time be determined by the Issuer.


Concession Card

means a Card which is issued by LTA and/or otherwise accepted for use by

(a) any Operator as a Ticket and for the payment of concessionary fares for travel on designated routes using the Public Transport System, and includes by reference:

  • Child Concession Card (“Child Card”)
  • Primary (MOE) Student Concession Card (“Primary (MOE) Card”);
  • Primary (Non-MOE) Student Concession Card (“Primary (Non-­MOE) Card”);
  • Secondary/Pre-U (MOE) Student Concession Card (“Secondary/Pre-U (MOE) Card”);
  • Secondary/Pre-U (Non-MOE) Student Concession Card (“Secondary/Pre-U (Non-MOE) Card”);
  • Institute of Technical Education Concession Card (“ITE Card”);
  • Tertiary Student Concession Card (“Tertiary Card”);
  • National Service Full-time Concession Card (“NSF Card”); and
  • Senior Citizen Concession Card (“Senior Citizen Card”); and

(b) any Qualified Merchants for payment of Qualified Goods and/or Services.


Concession Card Holder

 

means the holder of a Concession Card to whom the concession privilege is granted and whose name and NRIC or Birth Certificate number is printed on the Concession Card or recorded electronically in the Concession Card.


Concession Card System

means the computerised system operated and managed by TLPL or Qualified Merchants designated by the Land Transport Authority for Concession Card transactions and provision of Qualified Goods and/or Services.


Fares

means the amount payable to the Operators for Transit Services.


GTM

means a General Ticketing Machine.


Issuer

means the issuer of the Concession Card


LTA

means the Land Transport Authority of Singapore, a statutory body formed under the Land Transport Authority of Singapore Act (Cap. 158A).


Operators

means any licensee of any licence granted pursuant to section 12 of the Act or section 13 of the Rapid Transit Systems Act (Cap. 263A).


PSC

means Passenger Service Centre.


PTC

means the Public Transport Council of Singapore, as established under the Act.


Public Transport System

 

means the public bus and rail systems from time to time operated by the Operators.


Qualified Goods and/or Services

 

Means the goods sold and/or the services rendered by Qualified Merchants.


Qualified Merchants

means persons approved by LTA and/or Authorised Persons to be engaged in the sale of the Qualified Goods and/or the provision of Qualified Services. A Qualified Merchant is authorised by LTA to accept debits on the Stored Value of Concession Cards as a means of payment for such Qualified Goods and/or Services and provide services which involve the reading/writing of electronically encoded data on Concession Cards.


Rail

 

means the Mass Rapid Transit and Light Rapid Transit Systems


Revaluation

means the process whereby the Stored Value of a Card is increased by such means as prescribed by the Issuer and agreed by the holders of such Cards and the word “revalue” as used in these Conditions shall bear the same meaning.


Stored Value or stored value

means the initial monetary value paid for and stored in a Concession Card, including by means of a Revaluation, or the residual value remaining therein from time to time (excluding the Card Cost (as defined hereinafter)), which may be used by a Concession Card Holder for the payment of Transit Services and/or Qualified Goods and/or Services.


Ticket

means a Concession Card which is issued as a form of authorization for the conveyance of any passenger on the Public Transport System, as understood within the context and meaning of the Act.


TLCRO

means TLPL's Card Replacement Office.


TLPL

means Transit Link Pte Ltd, its successors and assigns.


TLTO

means TLPL's Ticket Office.


Transit Services

means the services from time to time provided by the Operators for or in connection with the transportation of passengers on the Public Transport System.


The following provisions shall apply to Concession Card Holders:

2. Issue and validity of Concession Cards

  2.1 Concession Cards shall be issued only to eligible applicants. Details on concession schemes, concession travel rates, eligibility for concession travel and conditions relating to concession schemes offered by the Operators are stipulated at www.transitlink.com.sg.
     
  2.2

A Concession Card is not transferable and can only be used by the Concession Card Holder of that Concession Card.

     
  2.3

The validity period of any particular type of Concession Card shall be as stated at www.transitlink.com.sg. The extension of any such validity period is at the absolute discretion of the respective Operators and shall, in the case of any Child Card, Primary (MOE) / (Non-MOE) Card, Secondary / Pre-U (MOE) / (Non-MOE) Card and/or Tertiary Card, be subject to the provision of all relevant information by the school or institution concerned. Save as aforesaid, Concession Card Holders may seek the extension of their concession status at any TLTO, TLCRO, AVM, GTM or PSC.

     
  2.4 The use of a Concession Card as a means for the payment of fares in the Public Transport System shall be subject always to these Conditions and such of the terms and conditions as may from time to time be issued by the Land Transport Authority or such other organisation as may be designated by the Land Transport Authority from time to time to govern the use of any contactless payment medium in the Public Transport System, which terms and conditions shall prevail over these Conditions in the event of any conflict or inconsistency.
     
  2.5

A replacement Concession Card may be issued subject to such conditions and to the payment of such sums as LTA may impose.

3. Revaluation of Concession Cards

Concession Card Holders may revalue the Stored Value of their Concession Cards from time to time at any TLTO, TLCRO, AVM, PSC and GTM via cash, NETS (or such other accepted payment modes), up to the maximum amount of $500 or other amount as may be prescribed for such Concession Card.

4. Card Cost

  4.1 LTA and/or any Authorised Person may collect from the Concession Card Holder an amount to cover the cost of the card (“ Card Cost ”) when the Concession C ard is first issued. The Card Cost, which is up to a maximum of S$5.00, is non-refundable.

5. Rejection of Concession Cards

  5.1 Notwithstanding any other clause, LTA, any Authorised Person, Operators and/or Qualified Merchants shall be entitled to reject the use of a Concession Card –
       
    5.1.1

as a Ticket and as a means for claiming concessionary travel in the Public Transport System if:­

    (a)

it is used by any person who is not eligible or who has ceased to be eligible for concessionary travel;

    (b)

it is used by any person who is not the Concession Card Holder of that Concession Card;

    (c)

it has expired;

    (d)

the Stored Value is insufficient or has been exhausted;

    (e)

it is suspected by LTA, TLPL, any Authorised Person and/or the Operators:

  (i) to be a counterfeit;
  (ii) to have been fraudulently or illegally issued or revalued;
  (iii) to have been stolen or tampered with in any way; or
  (iv) to have been used in a manner which illegally or fraudulently hinders or prevents the proper deduction of Fares or to evade any Fare payment;
    (f)

it is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the Concession Card System;

    (g)

it has been blacklisted for any reason whatsoever;

    (h)

it has not been activated for use in the Public Transport System;

   

(i)

it is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever;

   

(j)

the Concession Card System is unable to process the payment for any reason whatsoever or if a force majeure event (see Clause 15) arises which disables and/or prevents the Operators from accepting and/or processing the Concession C ard as a means of payment; and/or

       
    5.1.2

for payment of Qualified Goods and/or Services if:

    (a)

the Concession Card has expired; or

    (b)

the Concession Card is suspected to have been fraudulently issued, stolen or tampered with or may in any way pose a risk to the Concession Card System; or

    (c)

the Concession Card System is unable to process the payment for any reason whatsoever or if a force majeure event (see Clause 15) arises which disables and/or prevents the Qualified Merchants from accepting and/or processing the Concession Card as a means of payment.

     
  5.2 The Concession Card Holder agrees that each of the Operators and/or Qualified Merchants is responsible for deducting payment for Transit Services and/or Qualified Goods and/or Services, as the case may be, that the Concession Card Holder has agreed with the Operator and/or Qualified Merchant or is agreeable (with the Operator and/or Qualified Merchant) to pay from the Stored Value, in such manner as may be required by such Operator and/or Qualified Merchant.
     
  5.3 The Operators and Qualified Merchants accepting the use of Concession Cards may be changed from time to time without prior notice.

6. Retention of Concession Cards

  6.1 Notwithstanding any other clause, LTA, TLPL, any Authorised Person and/or any of the Operators shall be entitled to seize and retain the Concession Card if:¬
    (a)

it is used by a Concession Card Holder who is not eligible or who has ceased to be eligible for concessionary travel;

    (b)

it is used by a Concession Card Holder who is not the Concession Card Holder of that Concession Card;

    (c)

it has expired;

    (d)

it is suspected by LTA, TLPL, any Authorised Person and/or the Operators:

  (i) to be a counterfeit;
  (ii) to have been fraudulently or illegally issued or revalued;
  (iii) to have been stolen or tampered with in any way; or
  (iv) to have been used in a manner which illegally or fraudulently hinders or prevents the proper deduction of Fares or to evade any Fare payment;
    (e)

it is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the Concession Card System;

    (f)

it has been blacklisted for any reason whatsoever;

    (g)

it is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever.

     
  6.2 During the period that a Concession Card is retained, the Concession Card Holder shall not be entitled to the privilege of concessionary travel. In such instance, the Concession Card Holder may purchase an adult anonymous Card or use another appropriate form of Fare payment for travel in the Public Transport System. The Concession Card Holder may, however, make a claim in relation to any retained Concession Card in accordance with Clause 10.

7. Loss or Theft of Concession Card

  7.1 Concession Card Holders are responsible for safeguarding their Concession Cards from loss and theft. LTA, TLPL,Operators and Qualified Merchants shall not be responsible to any Concession Card Holder for any losses which may be incurred by a Concession Card Holder as a result of a lost or stolen Concession Card.
     
  7.2

Concession Card Holders who lose their Concession Card must immediately report the loss of their Concession Card to TLPL through the TransitLink Hotline for the purposes of invalidation. The lost card will be invalidated within 48 hours from the time of the report. Invalidation requests are final and irreversible.

8. Corrupted Concession Card

  8.1

Concession Card Holders with corrupted, defective or faulty Concession Cards shall present such corrupted Concession Cards to any TLTO, TLCRO or PSC immediately after such corruption, defect or fault has arisen.

     
  8.2

The Concession Card Holder may apply for a temporary Card (“Temporary Card”) at any TLTO or PSC pending the replacement of his/her Concession Card.

     
  8.3

Concession Card Holders who apply for a Temporary Card are required, unless otherwise determined by LTA and/or TLPL, to produce their Concession Card in respect of which the Temporary Card is issued.

     
  8.4

A Temporary Card shall only be valid for use for a period of ten (10) days. Corrupt Concession Cards Holders should collect their replacement Concession Cards at any TLCRO within the validity period of the Temporary Card.

9. Misuse of Concession Cards

A Concession Card may only be used by the respective Concession Card Holder who is eligible for concessionary travel of the type associated with the Concession Card and as stipulated at www.transitlink.com.sg. Concession Card Holders are responsible for safeguarding their Concession Cards from misuse.

10. Refunds

  10.1 A Concession Card Holder may claim a refund of any Stored Value rightfully due to the Concession Card Holder.
     
  10.2

Refunds shall be made by LTA, any Authorised Person or TLPL subject to the following conditions:

    (a)

The Concession Card in respect of which the claim is made must be presented unless otherwise determined by LTA, any Authorised Person or TLPL.

    (b)

The Concession Card must not have been altered, tampered, intentionally damaged, or interfered with.

    (c)

A refund shall be made only after LTA, any Authorised Person or TLPL is satisfied, after due investigation, that the claim is valid.

    (d)

The encoded data in the Concession Card and/or its external card number are readable for any reason as determined by LTA, any Authorised Person or TLPL.

    (e)

Refunds shall be made to the Concession Card Holder or its proxy.

    (f)

All refunds shall be made free of interest.

    (g)

Unless already retained, the Concession Card shall be surrendered to LTA, any Authorised person or TLPL at the time of refund.

     
  10.3 A Concession Card Holder may only obtain a refund of the Stored Value at any TLTO or TLCRO within 4 years after the expiry of that Concession Card.

11. Exclusion/Limitation of Liability:

  11.1 Neither LTA, TLPL, any Authorised Person, any Operator nor Qualified Merchant (or any of their respective officers, employees or agents) shall be liable for any losses, damages, expenses, claims, liability and costs (including cost on a solicitor and client basis) that a Concession Card Holder may incur or suffer in connection with:
    (a)

the use of any Concession Card as a Ticket and/or as a means of Fare Payment in the Public Transport System;

    (b)

any delay in the issuance of any Concession Card or in the case of any retained Concession Card, the return of such Concession Card;

    (c)

the retention, suspension, discontinuance or revocation of any Concession Card;

    (d)

any breakdown or fault in the Concession Card System and/or; or

    (e)

any damaged, corrupted, defective, faulty Concession Card.

     
  11.2

Without prejudice to Clause 11.1 above, should any liability be attributed to LTA, TLPL, any Authorised Person and/or any Operator in connection with the use of any Concession Card as a Ticket and/or as a means of Fare payment in the Public Transport System and/or as a means of payment for any Qualified Goods and/or Services whatsoever, including but not limited to any event or incident arising from any negligence, the total liability of LTA, TLPL, such Authorised Person and/or such Operator to the Concession Card Holder under these Conditions and at law shall not exceed in aggregate the sum of S$500.

     
  11.3

It is expressly acknowledged by the Concession Card Holder that neither LTA, TLPL nor any Authorised Person is involved in the provision of the Transit Services and/or the Qualified Goods and/or Services offered by any Operator and Qualified Merchant respectively accepting the Concession C ard for payment. Neither LTA, TLPL nor any Authorised Person shall be liable in any way for the Transit Services and/or Qualified Goods and/or Services sold, rendered or provided by the Operators and/or Qualified Merchants (including without limitation any defect, disruption, failure or unavailability of or relating to any of such Transit Services and/or Qualified Goods and/or Services, as the case may be) or for any other disputes concerning the Transit Services and/or Qualified Goods and/or Services, all of which shall be the sole responsibility of the Operators and/or Qualified Merchants, as the case may be.

12. Amendment

LTA may from time to time amend, modify or vary any part of these Conditions without any prior notice to Concession Card Holders save that notice of any such amendments made shall be posted at any TLTO/TLCRO at MRT stations and bus interchanges and/or such other premises (including LTA’s website) as may be determined by LTA. The Concession Card Holder’s continued use of the Concession Card after the date of such notification shall constitute an affirmative acknowledgement by the Concession Card Holder of the amendments and shall be deemed to be the Concession Card Holder's acceptance of the revised Conditions.

13. No Waiver

No failure or delay on the part of LTA in exercising any power, right, or remedy under these Conditions shall operate as a waiver of such power, right, or remedy. Nor shall any single or partial exercise of any power, right, or remedy preclude the further or other exercise thereof, or the exercise of any power, right, or remedy that it may have.

14. Right of Third Parties

Any person or entity which is identified or referred to in these Conditions (whether as a class of persons or otherwise) shall be deemed to be a party to these Conditions and shall accordingly be entitled to the benefit of, and to enforce in its own right, any provision of these Conditions which may be relevant to it or them to the fullest extent permitted by law. Save as aforesaid, the Contracts (Rights of Third Parties) Act shall not apply to give any person or entity who is not a party to these Conditions any right to enforce any term of these Conditions. For the avoidance of doubt, nothing in this Clause shall affect the rights of any permitted assignee or transferee of these Conditions.

15. Force Majeure

Neither LTA, any Authorised Person, TLPL, nor any of the Operators nor Qualified Merchant shall be liable for any non-performance, error, interruption or delay in the performance of its or their obligations under these Conditions if the same is due, in whole or in part, directly or indirectly to an event or failure which is beyond its or their reasonable control including, without limitation: -

  (a)

flood, lightning, acts of God, exceptional weather conditions, floods, droughts, storms, high winds, typhoons, fire, earthquakes and other natural disasters;

  (b)

impacts with or by air crafts or aerial objects, terrorism (whether actual or threatened), explosions, wars, war­like operations, hostilities, insurgencies, invasions, epidemics, quarantines, acts of foreign or public enemies, hi-jacking or unlawful seizure or wrongful exercise of control of vehicles, curtailment of transportation facilities, civil commotion, riots, strikes or lock-outs on a city or industrial scale, industrial disputes, industrial actions by workmen, shortage of labour, goods and materials;

  (c)

judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact;

  (d)

power & telecommunication network failures;

  (e)

circumstances where communications lines and/or computer systems cannot be used for reasons attributable to any telecommunications carriers; and

  (f)

acts or omissions of any third party.

16. Indemnity

The Concession Card Holder hereby undertakes to indemnify and keep LTA, any Authorised Person, TLPL, each of the Operators and Qualified Merchants harmless from and against any and all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands, costs (including without limitation, legal costs on a solicitor and own client basis), awards, damages, losses and/or expenses however arising as may be directly or indirectly suffered or incurred by LTA, any Authorised Person, TLPL, the Operators and/or Qualified Merchants by reason of and/or as a result of any breach or non-compliance by the Concession Card Holder of these Conditions.

17. Governing Law

The construction, validity and performance of these Conditions shall be governed by and construed in accordance with the laws of Singapore.
